The Grow&Tell App and Website was created and is maintained by the University of Alaska Cooperative Extension Service (UAF CES). Your privacy is important to UAF CES. This privacy statement provides you with information regarding the personal information collected during your visits to the Grow&Tell app or website, how it is used, with whom it may be shared and what choices you have regarding collection and distribution of your personal information. The purpose of this app is to aggregate and share observations about crops you grow, and where they are grown.
What personal information may be collected?
When you register (create a profile) with Grow&Tell, we collect personally identifiable information, including your name and address. We may also ask for information about your areas of interest to provide relevant resources to better serve your needs.
Google Analytics will be used to gather non-identifiable information about unregistered users of Grow&Tell.
How will my information be used?
Any data you upload will be shared publicly. This includes comments, photos, and crop production data.
Information provided by unregistered users will be used only to follow-up on the particular question or comment from the user. Users have the option to register or opt-in to receive additional information or communications from UAF CES.
When users register, information may be used to provide tailored information and resources for each user based on areas of interest and geographical location. Geographical information may be used to provide a customized home page featuring relevant local information and news. Information collected on your areas of interest may be used to provide you with publications and news related to your interests on your personalized home page. Registered users have the option to allow UAF CES to share your personally identifiable information with local Cooperative Extension offices to better serve your needs. You may also choose to receive local Cooperative Extension newsletters and other communications. To ensure your privacy, you will be provided with a way to unsubscribe from any newsletters you may receive.
Information sharing and disclosure
The location of your data will be shared, however, it will be blurred so that your exact location is not shared.
We do not share or sell your personally identifiable information to third parties. Registered users will have the choice to opt-out of any sharing of personal information with our partner universities or local Cooperative Extension offices. We use cookies at Grow&Tell to collect anonymous traffic data via Google Analytics.
While using the Grow&Tell app or website, you may sometimes encounter links to other companies or agencies that are not controlled by Grow&Tell or its partners. Please be aware that UAF CES is not responsible for the privacy practices of such other sites. We encourage you to be cautious when leaving the Grow&Tell app or website and carefully read the privacy statements of other websites.
If you make a comment, use a bulletin board or chat room on this site, you should be aware that any personally identifiable information you submit there can be read, collected or used by other users of these forums, and could be used to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums.
Access to personally identifiable information
If your personally identifiable information changes, or if you no longer want to be a part of the Grow&Tell app and website, you may correct, update, or deactivate your profile by making the change on your account information page or by emailing Grow&Tell at privacy@Grow&Tell.org
Choice/Opt-Out
You may use the Grow&Tell app and website without creating a profile. Some features require you to input your name and e-mail address in order to receive follow-up from UAF CES. When you register with the Grow&Tell app and website, you will be asked to share personally identifiable information that will allow you to receive a personalized experience on the website. You may choose not to share information other than your username and e-mail address. We provide you the opportunity to "opt-out" of having your personally identifiable information used for certain purposes, including sharing your information with local Cooperative Extension offices, when we ask for this information.
If you choose to receive local newsletters or other communications and later decide you no longer wish to subscribe, you may opt out of receiving them by following the unsubscribe instructions included in each newsletter.
Security
We are committed to protecting the personal information you submit to us, and we follow generally accepted industry standards, including physical, managerial, and electronic procedures, to secure your information, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. These terms and conditions only pertain to the Grow&Tell app (the “App”) and website (the “Website”) operated by the University of Alaska Cooperative Extension Service. The App the Website provide users the ability to access information, data, and other content and materials (the “Content”) and community features (the “Public Areas”). By accessing the App, Content, or Public Areas, you, or, if you represent an entity or other organization, that entity or organization (in either case, the “user”) signifies user’s affirmative acceptance of this Terms of Use and acknowledges and agrees that this Terms of User forms a binding legal obligation on behalf of user. If the user does not accept all terms and conditions in this Terms of Use, please do not access the App or any Content.
UAF CES, reserves the right, in its discretion, to change or modify all or any part of this Terms of Use at any time, effective immediately upon notices published on the App. Additionally, UAF CES reserves the right to modify or discontinue the provision of the Content or any Public Areas at any time and within its sole discretion. Continued access to the App constitutes binding acceptance of this Terms of Use, including any changes or modification made by UAF CES as permitted above. Please be sure to review this Terms of Use periodically to ensure familiarity with the most current version. If at any time this Terms of Use is no longer acceptable to the user, the user should immediately cease all access to the App. Continued access to the App and Content is acceptance of those changes.
Site and Tools are for Personal, Noncommercial Use Only
The App and its Content, including, without limitation, text, graphics, images, photographs, illustrations, audio and video clips, software, links, and other material contained on the App, are for user’s own personal, noncommercial purposes only. The Content is not intended to be a substitute for professional advice. The user should not rely on any Content on the App to replace consultations with qualified professionals to meet the user’s individual needs.
UAF CES does not recommend or endorse any specific tests, professionals, products, procedures, opinions, or other information that may be mentioned on the App. Reliance on any information provided by Grow&Tell, employees or suppliers, third parties or others appearing on the App at the invitation of UAF CES, or other visitors to the App, is solely at the user’s own risk.
Access to the App and Content
Limited Personal, Noncommercial Access and Use
The user acknowledges that the App contains Content that is protected by copyright, trademark, or other intellectual property and proprietary rights of UAF CES or third parties. Exclusive title to the App and Content, and all such proprietary and intellectual property rights, remains with UAF CES or its licensors. The App is also subject to copyright protection as a collective work of Grow&Tell pursuant to applicable copyright law. The user agrees to comply with any copyright notices, information, or restrictions displayed on the App or contained in any Content available on or accessed through the App.
The Grow&Tell privacy policy and terms and conditions permits User to access the App and download and use the Content only for user’s own personal, noncommercial use. User may copy and reproduce the Content for its own personal, noncommercial use, provided that User does store any significant portion of any Content. User may not distribute or publicly display or publicly perform, as applicable, any portion of the Content. User must maintain in place all copyright, trademark, and other proprietary rights notices contained on or in any copies of any Content. User is granted no other right to access or use the App or any Content and user may not access or use the App or any Content for any other purpose, except as may be permitted by applicable law, rule or regulation.
As an express condition to accessing or using the App or any Content, the user may not, and will not permit any third party to: (1) access or attempt to access the App or Content except as expressly provided in this Terms of Use; (2) access the App in any unlawful manner or in any other manner that could damage, disable, overburden, or impair the App; (3) use automated scripts to collect Content from or otherwise interact with the App; (4) alter, modify, publish, transmit, reproduce, create derivative works from the App; (5) distribute, perform, display, sell, resell, lend, loan, lease, license, sublicense, transfer, or in any way exploit or make available any of the Content or the App, in whole or in part. Portions of the App and Content consisting of downloadable software may not be reverse engineered, disassembled, or decompiled unless specifically authorized by Grow&Tell or the owner of the software's patent and/or copyright. The user also agrees not to circumvent, disable or otherwise interfere with any security-related features of the App or the Content, including features that prevent or restrict use or copying or that enforces limitations on access.
All trademarks, logos, and service marks displayed on the App are the sole and exclusive property of Grow&Tell or its third party licensors or suppliers. User is not permitted to use these trademarks, logos, and service marks of Grow&Tell or its licensors or suppliers without Grow&Tell’s prior written consent or the consent of such third party which may own the trademark, logo, or service mark.
Creative Commons Access
Grow&Tell has made available certain material on the App under the terms of the Creative Commons license. Material licensed under Creative Commons is expressly identified by the Creative Commons icon:

Expanded Use
Expanded access to or use of the App and any Content may be granted by contacting Grow&Tell’s Copyright Agent (listed below) and receiving prior written approval by the Grow&Tell designee. Use will not make any expanded use of the App or any Content without receiving such approval.
Equitable Relief
User agrees that UAF CES has expended significant monetary resources to develop the App and Content and that monetary damages would be inadequate to compensate UAF CES for any violation of this Terms of Use. Accordingly, user agrees and acknowledges that any such violation or threatened violation will cause irreparable injury to UAF CES and that, in addition to any other remedies that may be available, at law, in equity, or otherwise, UAF CES shall be entitled to obtain injunctive relief against the actual or threatened violation of this Terms of Use or the continuation of any such violation by user without the necessity of posting a bond or proving actual damages to UAF CES.
Inaccuracy Disclaimer
The Content and material on the App could include technical inaccuracies, typographical errors, or omissions. UAF CES reserves the right to correct any errors, inaccuracies, or omissions, and to change or update information at any time without prior notice.
Liability of Grow&Tell and it's Licensors
User’s access to the App and the Content herein is at the user’s own risk.
When accessing the App, information will be transmitted over a medium that may be beyond the control and jurisdiction of Grow&Tell and its suppliers. Accordingly, UAF CES assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with access to the App.
THE GROW&TELL SITE, CONTENT, AND PUBLIC AREAS ARE PROVIDED ON AN "AS IS" AND “AS AVAILABLE” BASIS. GROW&TELL, ITS LICENSORS, ITS SUBCONTRACTORS AND ITS SUPPLIERS, TO THE FULLEST EXTENT PERMITTED BY LAW, DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE. In no event shall UAF CES, its licensors, its subcontractors, its suppliers, or any third parties mentioned on the App be liable for any damages (including, without limitation, direct, indirect, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the access to or inability to access or use the App or Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not UAF CES, its licensors, its subcontractors, its suppliers, or any third parties mentioned on the App are advised of the possibility of such damages. UAF CES, its licensors, its subcontractors, its suppliers, or any third parties mentioned on the App shall be liable only to the amount paid by the user, if any, for accessing the App. UAF CES, its licensors, its subcontractors, its suppliers, or any third parties mentioned on the App are not liable for any personal injury, including death, caused by the access to or misuse of the App, Content, or Public Areas. Any claims arising in connection with access to the App, any Content, or the Public Areas must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under this Terms of Use are exclusive and are limited to those expressly provided for in this Terms of Use.
Certain state laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to the user, some or all of the above disclaimers, exclusions, or limitations may not apply and the user might have additional rights.
Children's Privacy
UAF CES is committed to protecting the privacy of children. UAF CES is dedicated to safeguarding any personal information collected online and to helping parents and children have positive experiences on the Internet. Consistent with the Children's Online Privacy Protection Act of 1998, UAF CES will never knowingly request personally identifiable information from anyone under the age of 13 without prior verifiable parental consent.
Parents can revoke their consent and ask that information about their children be deleted from the App by contacting UAF CES offices via email. To do this or to review personal information collected from children, UAF CES must verify the identity of the requesting parent. When a parent revokes consent, UAF CES will stop collecting, using, or disclosing information from the child. To respect the privacy of parents, information collected and used for the sole purpose of obtaining verifiable parental consent or providing notice is not maintained in a retrievable form by the site if parental consent is not obtained after a reasonable time.
Public Areas
If the user accesses a Public Area, the user is solely responsible for his or her own communications, the consequences of posting those communications and reliance on any communications found in the Public Areas. Grow&Tell and its licensors, its subcontractors and suppliers are not responsible for the consequences of any communications in the Public Areas. In cases where the user feels threatened or believes someone is in danger, the user should contact local law enforcement agency immediately.
In consideration of being allowed to access the App and Public Areas, the user agrees that the following actions shall constitute a material breach of this
Terms of Use:
Accessing the App or Public Areas for any purpose in violation of local, state, national or international laws;
Posting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
Posting material that is unlawful, slanderous, obscene, defamatory, threatening, harassing, or abusive to any other person or entity as subjectively determined by UAF CES;
Posting advertisements or solicitations of business;
Disrupting the normal flow of dialogue or posting comments that are not related to the topic being discussed after receiving a warning to discontinue;
Posting chain letters or pyramid schemes;
Impersonating another person or accessing the App or a Public Area on behalf of any third party;
Distributing viruses or other harmful computer code;
Collecting information about others, including email addresses, without their consent;
Allowing any other person or entity to use the user’s Account or Account ID for posting or viewing comments;
Posting the same note more than once or "spamming";
Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the Public Areas or the App, or which, in the judgment of UAF CES, exposes, UAF CES or any of its customers or suppliers to any liability or detriment of any type; or
Introducing unauthorized software, automated or aggregating agents or scripts to the App, Content, or Public Areas so as to produce multiple accounts, generate automated searches, requests, and queries, or to strip, scrape, or mine data from the App.
UAF CES reserves the right (but is not obligated) to do any or all of the following:
Record the dialogue in public chat rooms;
Investigate an allegation that a communication does not conform to the terms of this section and determine in its sole discretion to remove or request the removal of the communication;
Remove communications or submissions which are abusive, illegal, or disruptive, or that otherwise fail to conform to this Terms of Use;
Suspend or terminate a user's access to any or all Public Areas and/or the App upon any breach of this Terms of Use;
Monitor, edit, or disclose any communication in the Public Areas; and
Edit or delete any communication or submission posted on the App, regardless of whether such communication or submission violates these standards. Grow&Tell or its licensors have no liability or responsibility to users of the App or any other person or entity for performance or nonperformance of the aforementioned activities or to make available any portion of the App or Public Areas.
User Submissions
The personal information submitted to Grow&Tell is governed by the Grow&Tell Privacy Policy. To the extent where there is an inconsistency between this Terms of Use and the Grow&Tell Privacy Policy, this Terms of Use shall govern.
The user agrees that he or she will not upload or transmit any communications or submissions of any type to the Public Areas (including message boards) that infringe or violate any rights of any party, that violate this Terms of Use, or that user knows to be inaccurate, false, or misleading. User represents and warrants that user owns the full and exclusive right, title, and interest to user submissions (including the right to disclose the submission to Grow&Tell ), and that user is submitting only information or requests on its own initiative for its personal, noncommercial purpose and not on behalf of any other third party. By submitting communications or submissions to the Public Areas, the user agrees that such submission is non-confidential for all purposes.
If the user makes any such submission, the user agrees that he or she will not send or transmit to Grow&Tell by email—including through the email addresses listed on the "Contact Us" link - —any communication or submission that infringes or violates any rights of any party. If the user submits any business information, idea, concept, or invention to Grow&Tell by email, the user agrees each submission is non-confidential for all purposes.
If the user makes any submission to the Public Areas or if the user submits any business information, idea, concept, or invention to UAF CES by email, the user automatically grants—or warrants that the owner of such communication or intellectual property has expressly granted—UAF CES a royalty-free, perpetual, irrevocable, world-wide non-exclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform, and display the communication or submission in any media or medium, or any form, format, or forum now known or hereafter developed. UAF CES may sublicense its rights through multiple tiers of sublicenses.
Account
User may be required to establish an account on the App (an “Account”) to access certain Content, Public Areas, and other features of the App. Each Account and the user identification and password for each Account (the “Account ID”) is personal in nature. Each Account is for your personal, non-commercial access to the App in accordance with these Terms of Use and each Account ID may not be used by or on behalf of any third party. User is fully responsible for all liabilities and damages incurred through the use of user’s Account ID (whether lawful or unlawful) and that any transactions completed through user’s Account or with user’s Account ID will be deemed to have been lawfully completed by user. It is the user’s sole responsibility to (1) control the dissemination and use of user’s Account ID; (2) authorize, monitor, and control access to and use of user’s Account ID; (3) promptly inform UAF CES of any need to deactivate user’s Account ID; and (4) assist UAF CES in remedying any unauthorized action that results from the use of user’s Account ID. The user grants UAF CES and all other persons or entities involved in the operation of the App the right to transmit, monitor, retrieve, store, and use the user’s Account and Account ID in connection with the operation of the App. In connection with establishing and accessing user’s Account, user may be asked to submit certain information (“Registration Information”). User agrees that: (a) all Registration Information users provides will be accurate, true, and complete; and (b) user will maintain and promptly update user’s Registration Information to keep it accurate and current.
Suspension and Termination
UAF CES may suspend or permanently terminate a user’s access to user’s Account or Account ID, or user’s access to the App, with or without notice to user, upon any actual, threatened, or suspected violation of this Terms of Use or applicable local, state, national, or international law, or upon any other conduct deemed by UAF CES, in its sole discretion, to be inappropriate or detrimental to the App, Content, Public Areas, UAF CES, any other user, or third party.
Subscription Services
If the user chooses to subscribe to one of Grow&Tell 's subscription services, the following additional terms and conditions will apply depending on which service is chosen. The user should be aware that the Grow&Tell subscription services are not intended or designed to attract children under the age of 18.
Information the User Submits: The user is using the subscription services at his or her own risk and is personally responsible for verifying its suitability for the user’s needs.
Charges and Billing: The user is responsible for providing a valid credit card number at the time of registration for a subscription service. The user represents and warrants that he or she is an authorized user of such credit card, and the user agrees to pay all charges resulting from the subscription service account at the prices then in effect, including any unauthorized charges incurred prior to notifying UAF CES of such charges. The user agrees that Grow&Tell may pass the credit card information and related personally identifiable information to its designated service provider(s) for their user in charging the user for appropriate services utilized through the subscription service. All subscription service charges are exclusive of sales or other taxes and the user is responsible for payment of any applicable state, local, and city taxes. UAF CES reserves the right to modify or terminate membership plans, change prices, or institute new charges for any subscription service at any time with at least thirty (30) days' notice.
Searches, Advertisements, and Links to Other Apps
Grow&Tell may provide links to third-party websites. Grow&Tell also may select certain websites as priority responses to search terms the user enters and Grow&Tell may agree to allow advertisers to respond to certain search terms with advertisements or sponsored content on the App. UAF CES does not recommend and does not endorse the content on any third-party websites. UAF CES is not responsible for the content of linked third-party websites, websites framed within the App, third-party websites provided as search results, or third-party advertisements, and does not make any representations regarding their content or accuracy. Use of third-party websites is at the user’s own risk and subject to the terms and conditions of use for such websites. UAF CES does not endorse any third-party product advertised on the App.
Indemnity
The user agrees to defend, indemnify, and hold UAF CES, its officers, directors, employees, agents, licensors, subcontractors and suppliers, harmless from and against any claims, losses, actions, demands, liabilities, damages, fees, expenses, costs, and settlements (including, without limitation, reasonable legal and accounting fees, costs, awards, and settlement amounts, or any fees or amounts expended to investigate or pursue a claim, or possible claim, for indemnification under this “Indemnity” section), resulting from, or alleged to result from, the user’s violation of this Terms of Use or user’s access to or use of the App or Content.
Each party hereby assumes any and all risks of personal injury and property damage attributable to the negligent acts and omissions of that party and the officers, employees, and agents thereof. Neither party shall be responsible for the personal injury and property damage attributable to the negligent acts and omissions of the other party and the officers, employees, and agents thereof. To the extent permitted by state law and not inconsistent with the doctrine of sovereign immunity, the user agrees to accept responsibility for its negligent acts and omissions and damages proximately caused thereby.

Grow&Tell is a partnership of the University of Alaska Fairbanks Cooperative Extension Service in cooperation with Cornell University that was created with funding from the eXtension foundation.
General
Grow&Tell is an app developed by the University of Alaska Fairbanks Cooperative Extension Service in cooperation with Cornell University. Grow&Tell makes no claims that App or its Content is appropriate or may be downloaded outside of the United States. Access to the App and Content may not be legal by certain persons or in certain countries. If the user accesses the App from outside the United States or exports Content or information obtained from the App from the United States, the user does so at his or her own risk and is responsible for compliance with the laws of the user’s jurisdiction.
The following provisions survive the suspension or termination of user’s access to user’s Account or Account ID, or user’s access to the App for any reason whatsoever: Liability, User Submissions, Indemnity, Jurisdiction, and Complete Agreement.
Jurisdiction
The user expressly agrees that exclusive jurisdiction for any dispute with UAF CES, or in any way relating to access to the App, resides in the courts of the State of Alaska and further agrees and expressly consents to the exercise of personal jurisdiction in the courts of the State of Alaska in connection with any such dispute, including any claim involving UAF CES or its affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and Content providers. This Terms of Use is governed by the internal substantive laws of the State of Missouri, without respect to its conflict of laws principles.
For all parties, if any provision of this Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the remaining provisions of this Terms of Use, which shall remain in full force and effect. No waiver of any of this Terms of Use shall be deemed a further or continuing waiver of such term or condition or any other term or condition.
Notice and Take Down Procedures
If the user believes any materials accessible on or from the App infringes his or her copyright, the user may request removal of those materials (or access thereto) from the App by contacting UAF CES’s Copyright Agent (identified below) and providing the following information:
Identification of the copyrighted work that the user believes to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) or an authorized version of the work.
Identification of the material that the user believes to be infringing and its location. Please describe the material and provide the URL or any other pertinent information that will allow UAF CES to locate the material.
The user’s name, address, telephone number, and email address.
A statement that the user has a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law.
A statement that the information that the user has supplied is accurate, and indicated that "under penalty of perjury," the user is the copyright owner or are authorized to act on the copyright owner's behalf.
A signature or the electronic equivalent from the copyright holder or authorized representative.

Complete Agreement
Except as expressly provided in a particular "legal notice" on the App, this Terms of Use and the Privacy Policy constitute the entire agreement between the user and UAF CES with respect to the access to the App, Content, and Public Areas. UAF CES hopes the App is helpful and convenient to use.
